Terms of Service

SleepShift is a structured wellness program based on the Cognitive Behavioral Therapy for Insomnia (CBT-I) protocol ("the Program" or "the Service"). The Service is designed to help adults implement the CBT-I protocol through guided daily tracking, weekly adjustments, and structured cognitive exercises.

SleepShift is not a medical treatment, medical device, prescription software, or healthcare service. It is a wellness program based on publicly available clinical research. It does not diagnose, treat, cure, or prevent any disease or medical condition.

You may use SleepShift if you:

• Are 18 years of age or older;
• Are not currently under active psychiatric treatment for a condition that would be contraindicated with sleep restriction (if in doubt, consult your healthcare provider);
• Do not have an active, unmanaged diagnosis of obstructive sleep apnea or another sleep disorder for which CBT-I is contraindicated, unless you have received medical clearance;
• Agree to these Terms in full.

SleepShift reserves the right to terminate accounts that do not meet eligibility requirements.

You must create an account to access the full Program. You are responsible for maintaining the security of your account credentials. You may not share your account with another person.

Creating an account and viewing your assessment results is free. Continued access to the full program requires an active subscription — free for the first 7 days for new customers, then billed monthly — as described in Section 4.

Access to the full SleepShift Program is sold as an auto-renewing subscription, currently:

• Free trial — your first 7 days are free. A payment method is collected when you start, but nothing is charged during the trial.
• Monthly membership — $29.99 USD per month, billed monthly, starting automatically on day 8 unless you cancel during your free trial.
• The free trial is available once per customer. If you have previously held a SleepShift subscription, a new subscription begins (and is billed) on the day you purchase, as disclosed at checkout.

We may offer different promotional pricing, trial structures, or plan terms in different funnels or at different times. The exact price, billing cycle, and renewal terms of your plan are always disclosed at checkout before you pay, and those checkout terms control for your subscription.

All subscriptions auto-renew at the end of each billing period at the rate disclosed at checkout until you cancel. The exact price, billing cycle, and renewal terms are disclosed at checkout before you pay. You may cancel at any time from your account settings in one click; cancellation takes effect at the end of the current billing period, and you keep access until then. No cancellation fees.

Payments are processed by our third-party payment processors — currently Stripe; some subscriptions are processed by Lemon Squeezy. SleepShift does not store your payment card information.

HSA/FSA: SleepShift may qualify as an eligible HSA/FSA expense. Consult your plan administrator. SleepShift does not guarantee HSA/FSA reimbursement eligibility in all circumstances.

You may request a full refund of all amounts paid within 14 days of your first charge (your first monthly payment — during a free trial nothing has been charged, so there is nothing to refund and the 14-day window has not started). Contact us at support@sleepshift.app and your refund will be processed within 5 business days. After the 14-day window, subscription payments are non-refundable, but you may cancel at any time to stop future charges.

All content on SleepShift — including program content, design, software, and documentation — is owned by MK Solutions LLC and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Service without prior written consent.

Your use of SleepShift involves the collection and processing of personal data including your sleep diary entries and program progress. This data is handled in accordance with our Privacy Policy, which is incorporated by reference into these Terms.

Your sleep diary data may be processed by third-party AI services (currently the OpenAI API, for in-app reflection sessions) to generate personalized cognitive restructuring guidance. This processing requires your explicit consent, given at account creation and withdrawable at any time, as described in our Privacy Policy. Messages you send to the support chat on our public website are processed by the Groq API and are not connected to your sleep diary or program data.

To the maximum extent permitted by applicable law, SleepShift and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

SleepShift's total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid for the Service.

Sleep restriction therapy involves deliberate reduction in time in bed and may cause temporary increased daytime fatigue. This is an expected and normal part of the protocol. If you experience severe adverse effects, discontinue use and consult a healthcare provider.

SleepShift is not appropriate for all users. See Section 2 (User Eligibility) for contraindications. If you are unsure whether CBT-I is appropriate for your situation, consult a licensed healthcare provider before starting.

SleepShift is not an emergency service. If you are experiencing a medical or psychiatric emergency, contact emergency services immediately.

You may terminate your account at any time by contacting us. SleepShift may terminate or suspend your account for breach of these Terms. Termination does not entitle you to a refund beyond the refund policy in Section 5.

These Terms are governed by the laws of the Republic of Cyprus, without regard to conflict-of-law principles and without prejudice to any mandatory consumer-protection rights you may have under the laws of your country or state of residence — including consumers in the EU/EEA and in US states such as California. Any disputes arising from these Terms shall be resolved in the courts of the Republic of Cyprus.

We may update these Terms from time to time. We will notify you of material changes by email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.
